Terms and Conditions of Sale

Preliminary note

These Terms and Conditions of Sale govern all purchases made through magicskin.club. By completing an order, the customer declares to have read, understood and fully accepted these conditions. We recommend keeping a copy.

Art. 1 — Seller

The site magicskin.club is operated by:

Art. 2 — Subject matter

These Terms and Conditions govern the sale of physical products through magicskin.club to private customers (consumers) and professionals resident in Italy and in European Union countries.

Art. 3 — Products

Colony Italia Srl endeavours to describe its products accurately and completely. The images on the site are purely illustrative: colours, textures and details may vary slightly from what appears on the customer’s screen depending on device settings.

Colony Italia Srl reserves the right to modify, update or discontinue the sale of products at any time without prior notice.

Art. 4 — Prices

All prices shown on magicskin.club are expressed in Euros and include applicable VAT, unless explicitly stated otherwise.

Colony Italia Srl reserves the right to modify prices at any time. The price applicable to the customer’s order is that shown at the time of order confirmation. Any subsequent price changes will not affect already confirmed orders.

Art. 5 — How to order

To make a purchase on magicskin.club, the customer must:

1. Select the desired products and add them to the cart
2. Proceed to checkout by entering shipping and billing details
3. Choose a payment method
4. Review the order summary
5. Confirm the order by accepting these Terms and Conditions and the Privacy Policy

Submitting an order constitutes a purchase proposal. Colony Italia Srl reserves the right to refuse or cancel any order in the event of pricing errors, product unavailability, suspected fraud or irregularities. In such cases, the customer will be promptly informed and any amount charged will be fully refunded.

Art. 6 — Order confirmation

Upon receipt of the order, the customer will receive a confirmation email at the address provided at checkout. This email constitutes an acknowledgement of the order and does not represent final acceptance of the contract. The contract is deemed concluded upon shipment of the ordered products, confirmed by a dedicated shipping email.

Art. 7 — Payment methods

The following payment methods are accepted on magicskin.club:

• Credit and debit card (Visa, Mastercard, American Express) — via Stripe
• Bank transfer — bank details are provided at the end of the order; shipment takes place after receipt of payment

Card payments are processed securely by Stripe Inc. Colony Italia Srl does not access or store the customer’s card data. The connection is protected by SSL encryption.

In the event of non-payment or unauthorised payment, Colony Italia Srl reserves the right to cancel the order.

Art. 8 — Shipping and delivery

Colony Italia Srl ships to Italy and all European Union countries via GLS and FedEx couriers.

8.1 Delivery times

Estimated delivery times are 3–5 business days from the date of shipment. These are indicative times provided by couriers and not guaranteed deadlines. Colony Italia Srl is not responsible for delays attributable to couriers, force majeure events or customs procedures.

8.2 Shipping costs

Shipping costs range between €9.00 and €15.00 depending on the destination and order weight. The exact cost is calculated and displayed at checkout, before order confirmation.

8.3 Inspection on delivery

The customer must check the integrity of the package upon delivery. If the package is visibly damaged or tampered with, we recommend accepting the package with written reservation on the courier’s document, or refusing delivery, and reporting the matter promptly to roberto@robertograndis.com.

Art. 9 — Right of withdrawal and returns

Consumer customers have the right to withdraw from the contract within 14 days of receiving the order, without needing to provide reasons. For detailed information on the methods, conditions and procedures for returns and refunds, please refer to the Returns and Refunds Policy.

Art. 10 — Legal guarantee of conformity

All products sold on magicskin.club are covered by the legal guarantee of conformity provided for by Arts. 128–135 of Legislative Decree 206/2005 (Consumer Code), for a period of 2 years from the date of delivery.

In the event of a lack of conformity, the customer is entitled, in order of priority, to:

• repair or replacement of the product;
• price reduction or contract termination, where repair and replacement prove impossible or excessively burdensome.

To report a defect, write to roberto@robertograndis.com within 2 months of discovering the defect.

Art. 11 — Limitation of liability

Colony Italia Srl shall not be liable for indirect, incidental or consequential damages arising from the use of purchased products, except where liability cannot be excluded by law.

Colony Italia Srl’s liability shall in no case exceed the value of the order giving rise to the dispute.

Art. 12 — Intellectual property

All content on magicskin.club (texts, images, logos, graphics, site structure) is owned by Colony Italia Srl or used under licence. Reproduction, distribution or unauthorised use of such content without the prior written consent of Colony Italia Srl is prohibited.

Art. 13 — Dispute resolution

In the event of a dispute relating to the interpretation or performance of these Terms and Conditions, the consumer customer and Colony Italia Srl undertake to seek an amicable solution in the first instance by contacting roberto@robertograndis.com.

Consumers resident in the European Union may also use the online dispute resolution (ODR) platform made available by the European Commission at: ec.europa.eu/consumers/odr

Art. 14 — Governing law and jurisdiction

These Terms and Conditions are governed by Italian law. For any dispute arising from or connected to these Terms and Conditions, the Court of Bassano del Grappa (VI) shall have exclusive jurisdiction, without prejudice to the consumer’s right to bring proceedings before the court of their place of residence or domicile, pursuant to Art. 33, paragraph 2, letter u) of Legislative Decree 206/2005.

Art. 15 — Changes to these Terms

Colony Italia Srl reserves the right to modify these Terms and Conditions at any time. Changes will take effect from the date of publication on the site. Orders already confirmed at the time of the change remain governed by the Terms in force at the time of their conclusion.
